KitchenAid Blender Giveaway November 2019.
Sponsored by That Skinny Chick Can Bake, LLC
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL
NOT INCREASE THE CHANCES OF WINNING. VOID WHERE
PROHIBITED OR RESTRICTED BY LAW.
1. Promotion Period: KA Blender Giveaway (the “Promotion”)
commences at 12:00 AM Eastern Time (“ET”) on December 18, 2019, and ends
at 12:00 AM ET on December 26, 2019 (the “Promotion Period”). All entries
must be received by 11:59:59 PM ET on December 26, 2019. Entries submitted
past the expiration of the Promotion Period will not be accepted.
2. Administrator/Sponsor: The Promotion shall be
administered and sponsored by That Skinny Chick Can Bake, LLC
(the “Sponsor”). This Promotion is not sponsored,
administered, or associated with KitchenAid or Yummly.
3. Eligibility: The Promotion is open only to legal
residents of the fifty (50) United States and the District of Columbia
(excluding Puerto Rico and all other US territories) who are eighteen (18)
years of age or older at the time of entry, who enter via the Promotion Post
(as defined below) on Instagram. Employees of the Sponsor, their respective
affiliates, subsidiaries, advertising and promotion agencies, suppliers,
and their immediate family members and/or those living in the same household
of each are not eligible to participate in the Promotion. The
Promotion is subject to all applicable federal, state, and local laws and
regulations. Void where prohibited.
4. Agreement to Rules: By participating, you agree to be
fully unconditionally bound by these Rules, and you represent and warrant
that you meet the eligibility requirements set forth herein. In addition, you
agree to accept the decisions of the Sponsor as final and binding as it relates
to the content. The Promotion is subject to all applicable federal, state, and
local laws.
5. How to Enter: To enter the Promotion, an entrant (“Entrant”)
must via a standard web browser to the website:
(the “Promotion Post”) at any time during the Promotion Period and follow
the on-screen instructions to register an entry with the Sponsor by completing
all requirements listed (the “Primary Entry”). All Primary Entries must be
received by 11:59:59 PM ET on December 26, 2019. Limit (1) Primary Entry per
person or email. For extra entries (“Extra Entry”), the Entrant may follow
the Rafflecopter Prompts. All Extra Entries must be public. Extra Entries
must be published and tagged by 11:59:59 PM ET on December 4, 2019.
Primary Entries and Extra Entries must fulfill all Promotion requirements, as
specified, to be eligible to win a prize. Entries that are not complete or
do not adhere to the rules or specifications may be disqualified at the sole
discretion of the Sponsor. You may not enter more times than indicated by using
multiple email addresses, identities, or devices in an attempt to circumvent
the rules. If you use fraudulent methods or otherwise attempt to circumvent
the rules, your submission may be removed from eligibility at the sole
discretion of the Sponsor.
6. Prizes: There is a total of one (1) Prize available to
be won in the Promotion, the K400 KitchenAid Blender
(collectively, the “Prize” or“Prizes”) which includes the following:
(1) K400 KitchenAid Blender.
The approximate retail value (“ARV”) for ALL Prizes available to be won in
this Promotion is $249.99. Actual/appraised value may differ at the time of
prize award. Prize recipient (the “Winner”) may not substitute, assign, or
transfer Prizes or redeem Prizes for cash, but Sponsor reserves the right, at its
sole discretion, to substitute a Prize (or any portion thereof) with one of
comparable or greater value. Further, Sponsor reserves the right to forfeit or
award any unclaimed or leftover Prizes at its sole discretion. Additional
restrictions may apply. Acceptance of prize constitutes permission for Sponsor
to use winner’s name and entry for purposes of advertising and trade without
further compensation unless prohibited by law.
7. Odds: The odds of winning depend on the number of eligible
entries received.
8. Winner Selection and Notification: The winner will be selected in a random
drawing under the supervision of the Sponsor. The winner will be notified via
the email he/she entered the Promotion within five (5) days following the Winner
selection. Sponsor shall have no liability for a Winner’s failure to receive
notices due to Winner’s Instagram notification or other security settings, or for
Winner’s provision of incorrect or otherwise non-functioning contact
information. If the selected winner cannot be contacted, is ineligible, or fails
to claim the prize within 48 hours from the time award notification is sent, Prize
may be forfeited and an alternate Winner selected. The receipt by winner of the
Prize offered in this Promotion is conditioned upon compliance with any and all
federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL
RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT
IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE PROMOTION AND ALL
PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
9. Taxes and Expenses: Any and all expenses imposed
as a result of the award of the Prize and any other fees or costs associated with
the Prize shall be solely the Winner’s responsibility, including without
limitation any and all federal, state, and/or local taxes (and the reporting
thereof). It is the Winner’s responsibility to understand and abide by any federal,
state, and/or local tax laws that may apply to the receipt of a Prize. The Winner
may be required to complete certain tax information reporting forms before upon
receipt of a Prize.
10. Rights Granted by You: By entering this Promotion, you
understand that That Skinny Chick Can Bake, LLC, anyone acting on behalf of That
Skinny Chick Can Bake, LLC, or its respective licensees, successors, and assigns
will have the right, where permitted by law, without any further notice, review
or consent to print, publish, broadcast, distribute, and use, worldwide in any
media now known or hereafter in perpetuity and throughout the World, your entry,
including, without limitation, the entry content and Winner’s name, or
statements about the Promotion as news, publicity or information and for trade,
advertising, public relations, and promotional purposes without any further
compensation.
11. Terms: Sponsor reserves the right, in its sole discretion
to cancel, terminate, modify or suspend the Promotion should (in its sole discretion)
a virus, bugs, non-authorized human intervention, fraud, or other causes beyond its
control corrupt or affect the administration, security, fairness, or proper conduct of
the Promotion. In such case, the Sponsor may select the recipients from eligible
entries received prior to and/or after (if appropriate) the action taken by
Sponsor. Sponsor reserves the right at its sole discretion to disqualify any
an individual who tampers or attempts to tamper with the entry process or the
operation of the Promotion or website or violates these Terms & Conditions.
Sponsor has the right, in its sole discretion, to maintain the integrity of the
Promotion, to void votes for any reason, including, but not limited to; multiple
entries from the same user in excess of that allowed by Promotion rules; or the
use of bots, macros, or scripts, or other technical means for entering.
Any attempt by an entrant to deliberately undermine the legitimate operation of
the Promotion may be a violation of criminal and civil laws and should such an
attempt be made, Sponsor reserves the right to seek damages from any such
person to the fullest extent permitted by law.
12. Limitation of Liability: By entering the Promotion, you agree
to release and hold harmless That Skinny Chick Can Bake, LLC and its subsidiaries,
affiliate, advertising and promotion agencies, partners, representatives, agents,
successors assigns, employees, officers, and directors from any liability, illness,
injury, death, loss, litigation, claim or damage that may occur, directly or
indirectly, whether caused by negligence or not, from (i) such Entrant’s
participation in the Promotion and/or his/her acceptance, possession, use, or misuse
of any prize or any portion thereof; (ii) technical failures of any kind, including
but not limited to the malfunctioning of any computer, cable, network, hardware or
software, the unavailability or inaccessibility of any transmissions or telephone or
Internet service; (iv) unauthorized human intervention in any part of the entry
process or the Promotion; (v) electronic or human error which may occur in
the administration of the Promotion or the processing of entries.
By entering, Entrants confirm that they are at least eighteen (18) years of age at
time of entry with a US Mailing address.
Sponsor makes no warranties or guarantees about the Prizes once they are
shipped to the Winner.
13. Disputes: THIS PROMOTION IS GOVERNED BY THE LAWS OF USA
AND INDIANA, WITHOUT RESPECT TO CONFLICT OF LAW
DOCTRINES. As a condition of participating in this Promotion, participant
agrees that any and all disputes that cannot be resolved between the parties,
and causes of action arising out of or connected with this Promotion shall be
resolved individually, without resort to any form of class action, exclusively
before a court located in INDIANA having jurisdiction. Further, any such
dispute, under no circumstances, will the participant be permitted to obtain awards
for, and hereby waives all rights to claim punitive, incidental, or consequential
damages, including reasonable attorney’s fees, other than the participant’s
actual out-of-pocket expenses (i.e. costs associated with entering this
Promotion), and participant further waives all rights to have damages
multiplied or increased.
14. Privacy Policy: The winner will have to share his/her shipping
address with the Sponsor to claim the Prizes. The sponsor will not share the Winner’s
shipping address with any third party, other than those required to reasonably
complete delivery of the Prizes.
